Reckon — Terms of Service

1. Agreement

These Terms of Service ("Terms") are a legal agreement between you and Nova Solutions Limited, a company registered in Nigeria (RC 9168921) of Plot 19, Block L, Federal Housing Estate, Asaba, Delta State, Nigeria ("Reckon", "we", "us").

They govern your use of the Reckon mobile apps, the Reckon web app, and everything we provide through them (the "Service").

By creating an account, making a prediction, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Our Privacy Policy explains how we handle your personal data and forms part of these Terms.

2. What Reckon is

Reckon is a free football prediction game. Each gameweek of the English Premier League season, you predict the outcome of the fixtures. You can pick one of five options per match:

Points accumulate into global, national, club and private-league ("Squad") leaderboards.

We are not affiliated with the Premier League, the Football Association, or any football club. Club names, competition names and fixture data are used for identification only. All trade marks belong to their respective owners.

3. Eligibility

You may use the Service if:

• you are at least 13 years old; and
• if you are under 18, you have the consent of a parent or guardian, who agrees to these Terms on your behalf and is responsible for your use of the Service; and
• you are not barred from using the Service under the laws of your country; and
• your account has not previously been terminated by us for breach of these Terms.

We ask you to confirm your age band at sign-up and, if you are under 18, to confirm that a parent or guardian has agreed. Giving us a false age is a breach of these Terms.

Reckon is rated 12+ on the App Store and Teen on Google Play. It contains no real-money gambling and no simulated gambling mechanics — see section 4.

If you are using Reckon on behalf of an organisation, you confirm you have authority to bind it.

4. Reckon is not gambling

This section matters. Please read it.

Reckon is a free-to-enter game of skill and knowledge. Specifically:

• There is no stake. You never pay, deposit, wager, bet or risk anything of value to play, and no payment is ever required to make a prediction, join a leaderboard, create a Squad or improve your position.
• There are no cash prizes. Points, positions, badges and leaderboard standings have no monetary value, cannot be exchanged for money, goods or anything else of value, and cannot be bought, sold or transferred.
• There is no pooled fund. We do not collect, hold, pool or distribute money from users, and nothing users do creates a prize pool.
• The outcome depends on judgement, not chance mechanics. Reckon does not operate a lottery, a pool betting scheme, a fixed-odds product, a casino game, or any game of chance.

Accordingly, Reckon is not a betting, gaming, wagering or gambling service, and does not require a licence under the National Lottery Act 2005, the gaming and lotteries laws of Delta State or any other Nigerian state, nor under the gambling legislation of other jurisdictions we are available in.

Nothing on the Service is a betting tip, and nothing on it should be relied on for placing a bet. If you choose to gamble elsewhere, that is entirely your own decision and your own risk, and we accept no responsibility for it. If gambling is causing you or someone you know harm, please seek help from a support organisation in your country.

You must not use the Service to organise, promote, advertise or facilitate betting, staking, or any real-money contest — including through Squad names, handles, display names or any content you post. Doing so will get your account terminated.

5. Your account

Signing up. You can browse Reckon and make predictions before creating an account. To lock in your predictions you must create one, by signing in with Google or Apple and choosing a handle, display name, country and favourite club.

One person, one account. You may hold only one Reckon account. Creating additional accounts — to game a leaderboard, evade a suspension, or fill a Squad with duplicates — is a breach of these Terms and we may terminate every account involved.

Accuracy. Your country and other profile details must be truthful. Your country determines your national leaderboard and locks after you have played three gameweeks in a season.

Security. You are responsible for anything done through your account. Reckon has no password of its own — access depends on your Google or Apple account, so keep that secure. Tell us at hello@novasolutions.ng immediately if you believe someone else has access to your account.

Handles. Your handle is permanent and cannot be changed by you. We may change or reclaim a handle that is offensive, impersonates someone, infringes a trade mark, is used for advertising, or has been abandoned.

6. Playing fairly

You agree that you will not:

• make predictions on behalf of another person's account, or let anyone use yours;
• create or use multiple accounts, or automated accounts;
• use bots, scripts, scrapers or automated tools to submit predictions, read data, or interact with the Service;
• attempt to submit or alter a prediction after a gameweek deadline has passed, or exploit any bug that appears to allow it;
• attempt to view another user's predictions before the gameweek locks;
• reverse-engineer, decompile, or interfere with the Service, its APIs, or its security;
• probe, scan, overload or disrupt our systems, or attempt to gain unauthorised access to any account or data;
• collude with other users to manipulate a leaderboard;
• collect or harvest other users' data;
• use the Service for any unlawful purpose, or in breach of any law that applies to you.

If you find a bug or a security vulnerability, tell us at hello@novasolutions.ng rather than exploiting it. We will not pursue anyone who reports a genuine security issue responsibly and does not access or damage other users' data.

7. Deadlines, results and scoring

Deadlines are absolute. Predictions for a gameweek must be submitted before that gameweek's published deadline. After the deadline, predictions for that gameweek are locked, cannot be changed, and become visible to other users. Any match not predicted before the deadline scores zero.

You are responsible for getting your picks in. Push notifications and reminders are a courtesy, not a guarantee — we do not promise that any notification will be delivered, or delivered on time, and a missed notification is not a reason to reopen a deadline.

Results. We enter and verify match results from official and third-party sources. We take reasonable care but we do not warrant that fixture data, results, points or standings are accurate, complete or up to date at any given moment.

Corrections and rescoring. If a result is entered incorrectly, or an official result is later changed — for example, an abandoned match, an awarded result, or a correction by the competition — we may rescore the affected gameweek and adjust points and standings accordingly, at any time. Rescoring can move you up or down a leaderboard. Our decision on scoring is final.

Postponed, abandoned and rearranged matches. Where a match is postponed or abandoned, we will apply the approach published in the app for that season — typically, the match is scored on the official result if and when one is recorded, and voided if it is not played within the gameweek. We may change how these edge cases are handled between seasons and will publish the rules before the season starts.

Season and gameweek structure. We may change the number of gameweeks, the leaderboards offered, deadline times, or the scoring rules for future gameweeks. We will not change scoring rules retroactively for a gameweek that has already locked.

8. Squads (private leagues)

You can create a Squad and invite others with an invite code. If you create one, you choose the start and end gameweeks; if you do not, it runs from gameweek 1 to gameweek 38.

As a Squad creator you are responsible for who you invite and for the Squad's name. Squad names are subject to the content rules in section 9. We may rename or remove a Squad that breaches them.

Sharing an invite code publicly makes the Squad effectively open — that is your choice, and we are not responsible for who joins as a result.

We may cap the number of members in a Squad, or the number of Squads one account can create, and may change those limits.

9. Your content

What counts. "Your Content" means anything you supply that others can see: your handle, display name, avatar, Squad names, and any comments or messages if and when we introduce them.

You keep ownership. You own Your Content. You grant us a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for formatting and sizing) and distribute Your Content within the Service, including in leaderboards, reveal grids and share cards, for as long as you keep it on the Service and for a reasonable period afterwards in backups. This licence exists so we can run the Service; it gives us no right to sell Your Content or use it in advertising without asking you.

What you must not post. Your Content must not:

• be obscene, pornographic, or sexually explicit;
• be hateful, harassing, threatening, or attack anyone on the basis of race, ethnicity, nationality, religion, gender, sexual orientation, disability or any other protected characteristic;
• incite violence or promote self-harm;
• impersonate another person, a club, a public figure, or Reckon itself;
• infringe anyone's copyright, trade mark, privacy or other rights;
• contain another person's personal information;
• advertise, spam, promote gambling, or solicit money;
• be unlawful under Nigerian law or the law where you are.

We operate a blocked-terms filter on handles and display names, and we scan uploaded avatars automatically. Automated systems are imperfect in both directions — passing a filter does not mean content is acceptable.

Reporting and blocking. Every place another user's content appears in Reckon, you can report it and block that user. Blocking hides their content from you and prevents them from interacting with you. Reporting sends it to us: we review reports and may remove content, rename an account, suspend it, or terminate it. We aim to act on serious reports within 48 hours.

Copyright and trade mark complaints. If you believe something on Reckon infringes your rights, email hello@novasolutions.ng with: your contact details; identification of the work or mark and of the content you say infringes it (with a link or screenshot); a statement that you believe in good faith that the use is unauthorised; and a statement that the information is accurate and that you are the rights holder or authorised to act for them. We will investigate and remove infringing content promptly. If your content was removed and you believe that was wrong, reply to the same address with your reasons and we will review it. We terminate the accounts of repeat infringers.

Our discretion. We may remove any content or suspend any account that we reasonably believe breaches these Terms, without notice where the breach is serious. Where we suspend or terminate your account, we will tell you why unless doing so would be unlawful or would compromise an investigation. You can appeal to hello@novasolutions.ng and we will review the decision.

10. Our intellectual property

The Service — including the Reckon name, logo, club badge illustrations, design, artwork, copy, code, and the scoring system — belongs to us or our licensors and is protected by copyright, trade mark and other laws.

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial enjoyment, subject to these Terms. You may not copy, modify, distribute, sell, licence, frame, or create derivative works from any part of the Service, or use our branding, without our written permission.

You may share screenshots and share cards generated by the Service on social media. That is what they are for.

The club badges in Reckon are original illustrations created by us. They are not the official crests of any club and should not be presented as such.

11. Availability, changes and beta features

We provide the Service "as is" and "as available". We do not promise it will be uninterrupted, error-free, or available at any particular time — including immediately before a deadline. We may suspend the Service for maintenance, and will try to avoid doing so around deadlines.

We may add, change, or remove features at any time. We may discontinue the Service entirely, in which case we will give you at least 30 days' notice where reasonably practicable and let you export your data.

Some features may be labelled beta, preview or experimental. Those are provided with no warranty at all and may change or disappear without notice.

12. Ending your account

You can delete your account at any time — in the app under Settings → Account → Delete account, or from the web without signing in at https://reckonfc.com/delete-account.

Deletion is permanent: your profile and predictions are removed or anonymised in line with our Privacy Policy, your handle may be released, and you cannot recover your history or your leaderboard positions. Two things are kept: historical season records, in anonymised form; and a limited moderation record where your account was suspended or reported, for the period stated in section 8 of the Privacy Policy, so that a suspended account cannot simply be recreated.

We may suspend or terminate your account if you breach these Terms, if we are required to by law, or if we reasonably believe your use of the Service creates a risk or legal exposure for us or other users. Where the breach is minor and fixable, we will normally warn you first.

Sections 4, 9 (licence), 10, 13, 14 and 16 survive termination.

13. Disclaimers and limitation of liability

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for death or personal injury caused by our negligence, or for fraud or fraudulent misrepresentation.

Subject to that:

Disclaimer. To the fullest extent permitted by law, we exclude all warranties, conditions and terms implied by statute or common law, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that fixture data, results, points, statistics or standings are accurate or complete, or that the Service will meet your requirements.

No liability for reliance. The Service is entertainment. You must not rely on anything in it for betting, financial, or any other decision, and we have no liability if you do.

Exclusions. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profits, revenue, data, goodwill, opportunity, or anticipated savings — including loss caused by a missed deadline, an undelivered notification, a scoring correction, downtime, data loss, or a lost leaderboard position.

Cap. Because the Service is free, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms is limited to the greater of (a) the amount you have paid us in the twelve months before the claim (which will normally be zero) and (b) ₦50,000.

Other users. We are not responsible for the conduct of other users, on or off the Service, including anything they post, any Squad they run, or anything they arrange between themselves.

14. Indemnity

To the extent permitted by law, you agree to indemnify us against any claims, losses, liabilities and reasonable costs (including legal fees) arising from your breach of these Terms, your misuse of the Service, Your Content, or your infringement of anyone else's rights. We will tell you promptly about any such claim and will not settle it without consulting you.

15. Changes to these Terms

We may change these Terms. If a change is material, we will give you at least 14 days' notice in the app and by email where we have one, before it takes effect. Continuing to use the Service after that means you accept the new Terms. If you do not accept them, delete your account.

We will not apply changes retroactively to a gameweek that has already been scored.

16. Law, disputes and general

Governing law. These Terms and any dispute arising from them are governed by the laws of the Federal Republic of Nigeria.

Talk to us first. If you have a problem, email hello@novasolutions.ng. We will try to resolve it informally within 30 days. Most things end here.

Courts. If we cannot resolve it, the courts of Delta State, Nigeria have exclusive jurisdiction. If you are a consumer resident in a country whose law gives you the right to bring proceedings in your local courts, this clause does not take that right away.

No class actions. To the extent permitted by law, disputes must be brought individually and not as part of a class or representative action.

Severability. If any provision is found unenforceable, it is modified to the minimum extent necessary or severed, and the rest remains in force.

No waiver. If we do not enforce a right, we have not waived it.

Assignment. You may not transfer your rights under these Terms. We may transfer ours to an affiliate or to a buyer of the business, provided your rights are not reduced.

Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.

Third parties. Nobody other than you and us has any right to enforce these Terms.

Force majeure. We are not liable for failure to perform caused by events beyond our reasonable control.

App stores. If you downloaded Reckon from the Apple App Store or Google Play, you also agree to that store's terms. Apple and Google are not parties to these Terms and have no responsibility for the Service. These Terms are between you and us alone; Apple and Google are third-party beneficiaries entitled to enforce this paragraph, and any support, maintenance, warranty or product-liability claim about Reckon should be directed to us, not to them.
